Derek Smith ~ Chester UK.    Joint owner with wife of Diamond Resorts timeshare points.   (Originally the Grand Vacation Cpompany)

Happy for many years until the company was taken over by Diamond Resorts and management fee escalated sharply.   (Probably to fund court defence costs)

There are so many disatisfied timeshare owners I am wondering if the industry is in general decline.

Hi bought our timeshare Palm Oasis in 2000, hubby made redundant in January 2009 unable to pay fees, still not found permanent job, I am about to be laid off work due to ill health so going to have trouble paying maintenance fees again, have asked resort to take the timeshare back no luck.  Have tried various ways of getting rid of it cannot even give it away.

When sold the timeshare was told it was a fantastic investment, never going down in price, that a resale centre would be set up (ha ha) that we would have no trouble reselling (even bigger joke) We need help cannot afford to pay to get us out of this continuing downward spiral of timeshare increasing costs.

Help badly needed.

I have owned a timeshare on the Costa Del Sol for about 9 years with MacDonalds. At first it seemed good value for money, but with the year on year increases in Maintenance fees, this hasn't been the case for many years. I naively thought if I asked them to take it back they would, but was told if I did not continue pay I would be taken to court. To make matters worse they say it passes on to the kids! And....all the ones who pay are paying a higher fee due to defaulters. Nobody wants to buy it either. (can't say I blame them, I wish I had had more sense!)

my name is Alison Jeatt we have a timeshare in Palm Oasis, Gran Canaria, hubby made redundant in 2009 and I am about to be medically retired due to ill health, due to finances etc we have not used our timeshare since 2008.  Have tried to sell it and even give it away to no avail.  Hopefully Itra will be able to help us. 

When we bought were told that it was a good investment for ourselves and children (who say clear off we don't want that millstone around our necks thanks), was told that we would be able to sell quite easily and that the value would go up year on year.  (think they meant the maintenance fees) was told by one of the sales guys he had bought twelve weeks as he thought it was such a good investment. 

They caught us at a weak moment in time as it was our wedding anniversary, our first trip abroad without children etc, tried to cancel when we got home to no avail as it was over the 7 day cooling off period (holiday was for two weeks).  ah well not the only ones in this situation.

I'm Alan Turner,My wife and I bought 2 weeks at Palm Oasis in 1997 after being taken to a"presentation"The salesman told us that
he had bought 12 weeks as an investment which would rocket in value and if we wanted to sell in the future,Palm Oasis would have a resale service.At that time we had no reason to disbelieve him.I did not have my credit card with me so I was taken to my hotel in a taxi while my wife was held prisoner.When I returned,I was persuaded to ring the credit card company and ask for a higher credit limit so I could pay the deposit.I can't believe I was so naive!I have not paid the maintenance fees for 2 years
and their debt collectors,Debtsave has sent me a Final Demand- Legal action Imminent letter for 2 years fees + interest which I
have refused to pay.My wife has a long term mental illness and will never be able to go.There is no law to stop these sharks
from demanding money from me until I die -and beyond.I'm 72 this month so,while I am still fit.I'm going to fight them and
tell the world.

Hi, yes I have been and although I felt a little under pressure I have now realised that disposing of the milstone of ?900 a year from around my neck is a big weight off

Hey Bernice

It was my understanding that ITRA were the brains behind the RCI Class Action and that one of their sponsors named Club Class were taking responsibility of my timeshare. Mind you I went to Maidenhead, maybe it is different in Chester. Please can you clarify as it would seems rather odd if ITRA had taken over your timeshare???

Hi, My name is Kim Bevis, my wife and myself have had a time-share (originally points with GVC) for a number of years and have been dismayed at the escalating maintenance fees. Having tried, and been ripped-off twice, to get rid of this commitment we have finally managed to do this with the help of ITRA. Yes we've signed up with Club Classic which cost but hopefully the pay-out from the legal claim should cover this, even if it doesn't, we still save in the long run with the amount we would have paid in maintenance fees being much higher (another 30+ years commitment) than what we have just paid.

We had time share with RCI Points for 10 years and basically have no grizzles about RCI and have had some nice holidays. However, the escalating maintenance fees have horrified us and as we are now both retired we have had great difficulty in finding the money. Some one has been very greedy here. We have been to talk to ITRA recently and hope hat all our problems are behind us but it has cost us money (which would have been spent on the maintenence fees) and I am still trying to get my head round it all. My husband is quite adamant that we have 'done' the right thing.

Hi my name is Don Wilson and my wife and I owned a week at Las Calas.Due to my wifes disability we can't take up our week in Lanzarote due to the amount of steps at the resort and like most other people have been unable to get a suitable swap.We have had Resort Solutions trying to sell for 3 years and reduced the price to zero eventually but no luck.We didn't pay the fees in January this year and they have added 3x ?10 and said that we no longer have access to the apartment and they will contact RCI to stop us trying to get a swap.They inferred that there will be further action with no notification from them. We are just waiting to see what happens next.

Hello all--I am a new member and for many years have owned at Oura View Beach Club--Sheraton Vistana and Oura Hotel.   THe Oura Hotel in the Algarve went to liquidation some 10 years ? ago and owners just received a solicitors letter saying you no longer own at this resort. Consequently I have neither received any maintenance bills and obviously havent paid any. I use the Oura View each year which is nearby the Oura Hotel[ but unrelated] go in and have a look around and find it operational-although the bars and restaurants are shut down. Nobody there is ever available to talk to me.   Has anyone any similar experiences or other info on OURA  HOTEL appt.

My name is Ken Richardson & my wife & I have owned timeshare for 20 years & have been relatively happy until the last 5 years when maintenance charges has got out of control.
We would like to hand them back but find that we can't .

Hi from Jean & Rab

We became members when we visited Livingstone last October where Itra took over our timeshares in Beverly Hills Club.  Although we have signed over our Deeds we are pestered with Maintenance reminders, Final Notices, and now Suspension of Membership. We phoned the Club explaining the transfer of our Deeds but they will not acknowledge Club Class as a company, and therefore retain our names on their records.

I am hoping Itra can help with this matter, or at least advise.

The purpose of visiting the office in Livingstone would have been for Itra to assist you in completing a pre-qualification claim survey based on a no win no fee basis.  You may then have had decided to take up an offer from this independent marketing company. If this is the case we advise for you to contact them directly with any queries you may have regarding your deeds.

Hi, My name is Robert Dann and my wife (Karen) amd I signed up for RCI points in July 2005 at Pearly Grey resort Tenerife.
Like many others out there we were told what a good investment this would be. The rest is history hence us signing up with ITRA.
However since we have I have received notification from the resort to say that the lease was being changed and that we would be out of the contract after 10 years. "Have they caught on......... Has anybody else received such notification?

New member to forum. Had a meeting at Bretton Hall Chester 06/02/12 and would like feedback from people who have been involved. My wife and I own 10500 Diamond points and can never use them. We our desperate too get rid. Hoping for a positive outcome. Is everybody happy with the service and has there been successes.

I have registered  with ITRA for a while but never log in.  I won Time share since 1986  I tried selling  with time share agency but no success,  I realise that the only enjoyment is to use  them and exchange to go different places yourself, cannot make money out of it,  just keep what you already invested... any further  upgrade  will require further investment..I hope this is helpful

I joined ITRA recently in order to find out if anyone has received compensation as a result of the "Lanzarote Court Case". This case was funded and supported by some 400 LBCMA members in the UK. Did you provide a Power of Attorney in support of this case?

Hi,

My parents bought in 1986 and have had good use out of their weeks in Tenerife. That said, the twist of timeshare escalating costs have poisened their memories.

Route of the problem is greed and so I am looking to support them in recovering any overpayments they have made in the past and to put to an end this chapter.

I have been a timeshare owner for 7 years, originally with Club la Costa, where maintenance costs rose from 70 to 1,500 within 3 years, then RCI with a timeshare at Compass Club in Tenerife. With all thge misinfromation and misselling I am down about 26,000, which I am trusting that ITRA can help me get at least some back ,with the class action against RCI

Hello, my name is Andrea Dehant.  I am a new member here and after my last visit to Albufiera with Petchey - soon to be Magnum - I  was harassed to set up a new contract, which would enable me to hand over all points in 5 years if I bought yet more infinity points.  I have too many already!

I also have a fixed week studio, as well as the infinity points.

I desperately need some help as the fear of God has been put in me!  We hear horrendous stories - although we have been members for 8 years and have been really happy with the holidays, and so far the maintenance fees have been manageable - just....  But after a meeting with the agents, who acted very strangely I got worried, I then looked into this forum, joined and hope that someone in a similar situation may be able to advise... or discuss - or anything!

My partner and I bought Club La Costa timeshare weeks. We haven't been able to afford to even use it since we bought it and are struggling to pay the maintenance fees due to his ill health and time off work (he is self employed too!)
We have just discovered that the money that he has been paying out of his account to pay these hasn't been picked up by CLC. they have no ideas where the money has gone but are 'loking into it'
want to get out of the contract and stop the fees!!

Hi, I am Jocelyn, my husband and I bought 30 points on 'the shoulder' season about 12 years ago, with UVC which was later sold to Atlas, then gobbled up by Petchey and now owned by another company, we were not able to take up a holiday every year and didn't like the resorts in Portugal, so were somewhat limited although we did buy 4 years membership with RCI which gave us more choice. No family members are interested and we are now getting too old and creaky and the flights costing more, so we want out, and today came the annual maintenance demand !!!!!!!!!help ITRA, whats the next step

I'm Kevin Pring and I live just outside of London in the UK. I was introduced to ITRA after being invited to a meeting in Spain by MultiClaims. My wife and I were put up in a lovely hotel near Malaga and met with the ITRA representatives Andrew and John as well as a Spanish solicitor. We have allegedly lodged a  compensation claim for being mis-sold our holiday points. We had 110 000 Petchey points which I paid 4,000, by way of a loan arranged on the day of the meeting in Spain, to dispose of. Anybody else using these folk?

My name is Tamara. We were pressured into buying our timeshare at the Royal Park Albatros in Tenerife some 10 years ago. We have NEVER ever used it. We will never use it and yet like mugs we were paying the maintenance fees until 2012. We are now being chased by Daniel & Silverman debt collectors as we can no longer pay our fees which were 200 at the start and now 980. My husband is unemployed and i had an accident and broke my back this year so not worked for over 4 months at present. We have moved house to save money by down sizing. We have been trying to sell our timeshare for years without success and we have asked petchey leisure to relinquish us from the timeshare and we walk away with nothing but they wont. We paid over 15,000 and cant give it away! We are desperate now and wondered if anyone new a way to get us out of our ownership without incurring more fees? Please help

Hi Tamara,

We are launching a new procedure for the Spanish resorts, or any ownership purchased in Spanish soil that I explane below.  This will be at a No Win No Fee, but obviously you will be commited to pay the admin and legal costs once your timeshare has been disolved with a porcentage which will be used to cover the inicial legal and administration costs. 

We are now taking a legal route with the Spanish resorts as there has been favourable within the Spanish courts against Timeshare mis-selling in respect of resorts situated within Spain which does of course include the Canary Islands and the Balearic Islands.

This action will be handled by our highly qualified Lawyers and Notaries.

In order to commence you will need to visit a local Notary to sign the POA in favour of our legal team.

Once Notarized the POA will need to be Apostilled and then returned to me.

The POA which includes a statement of misrepresentation.

I would arrange your appointment with a Local Notary or you may of course choose your own.
Once the Power has been returned our lawyers will take over and will inform you directly on progress made.

During the process, in the unlikely event that the resort refuses to comply with their obligations under Spanish law, and do send you a maintenance fee demand for the ensuing year, this must immediately be sent to our lawyer to take the relevant legal action.

Hello,

I am Collis and recently purchased a Marriott Timeshare, Playa Andaluza.  We were given the presentation and the sales person verbally stated that we could get Hotel discounts, specifically 20-40 euro/night, which was part of Interval International portion of the timeshare benefits. Besides all the other information, our main purpose was for these Marriott Brand Hotels.   After the contract closed (30 days later) we were able to get access to both MVCI and Interval International websites to further investigate.  The sales person's information was not accurate and false.  After discussing the issues with the, "Marriott Customer Advocates", we realize they are not advocates but really following the legality of the contract.  The say a misunderstanding occurred when there was not one.  According Spanish Timeshare law, under article 10 it states in section 2, "In the event that the information provided  to Purchaser is not accurate, Purchaser may file an action for annulment under articles 1300 et seq. of the civil code, without prejudice to any criminal liability which may be incurred by the transferor and to the provisions of the preceding paragraph".  What is the possibility in annulling the contract with Marriott Vacation Club International?  They have only used bullying tactics to see if we give up and accept what we say.

Hi to all members,

I purchased a fractional ownership/timeshare in the Torch building in Dubai for 14.000 in 2006, off plan, the building was to have taken 2 years to build, but it took 4 years, I was told buy the rep that I could expect 5000 a week rental, because I had the best 2 weeks, I also had to pay maintenance fee's in advance, the rep also told me that the condo would be sold after 15 years, and I could expect up to 50.000 for my share, the rep left the company shortly after, I WONDER WHY?, I have been complaining now for 4 years, but all I get is PR, saying our rep would not have said that, in short, you are a liar, they have told me since that the condo's termination date is May 2022, and that the condo will then be put on the open market, and everyone will get there share, I asked them to guarantee that this will happen, NO REPLY, I also asked them to justify the advance maintenance fee's, as anyone who as worked in construction knows that all maintenance in the 1st/2nd year is the responsibility of the main contractor, the only thing they can charge for is maid service, that comes to around 1500, they charged 10.400 for the condo in the 1st year, split 26 ways, I asked them what they spent the other 8900 on, again NO REPLY, I have since been told that if this company owns a share in each condo, when the termination date is up, if 1 shareholder refuse's to sell, then the condo, can not be sold ie, TIMESHARE, If anyone on this forum as had dealings with this company which is based in Wilmslow, Manchester, can you please contact me, I have never had any info on the condo from these people ie, floor plan/furniture list/photo's, anything that would enable me to rent it out, all I get is letters telling me when the maintenance fee's are due, and how much they have gone up, I have asked for these questions to be answered on 4 occasions, but all I get is 1 guy telling me how happy everyone is, If I can find 1 other person who was sold a condo share by this rep, and was given the same speel, then I have a case.

Hi, my husband and I have just put ourselves in the hands of ITRA to get rid of the Fractional Ownership we have with CLC (Club La Costa). I hope I am not throwing good money after bad! Never again will I allow myself to be persuaded to buy any 'holiday' product from anyone. What a con and the worst of it is that they are still conning people and getting away with it. We got stopped at Malaga airport on the way home after being to a meeting with ITRA by a CLC rep - I went and warned all the people she had got details from!!

In the exact same position as Gerry in the previous post - FPOC with CLC. I'm hoping ITRA come through on our behalf and that we're also not throwing good money after bad. There appears to be no love lost on either side online and it's difficult to find anyone independently with anything good to say. The Timeshare Consumer Assocation, however, are relatively supportive and have a very constructive article on their website about ITRA - [http://www.timeshareconsumerassociation.org.uk/2014/11/28/itra/].
Could do with some more up to date posts on this forum though, and a few success stories would be particularly reassuring. There surely must be some out there.
